Tendering Contract Manager (Offshore Wind)

ENGIE is looking for a Tendering Contract Manager (Offshore Wind).

Your mission

  • the Tender Contract Manager, under the direction of the Tender Manager, has overall responsibility for all tendering contractual activities from inception (Invitation To Tender) through to hand over to the project execution team
  • your strong communication skills enable you to develop close working relationships with the tendering-, project-, purchasing teams and the internal legal department
  • in particular you conduct contract briefings, advise in responding to contractual queries and assist proactively in the resolution of any issues
  • you maintain a positive business relationship with the client’s/partner’s contract management team by regularly communication and coordinating with them and engage with the client to resolve issues
  • ensuring and administering proper joint venture and/or consortium agreements, services agreements, non-disclosure agreements, a.o.
  • assume responsibility for all tendering contractual activities until all relevant contractual issues are resolved/settled in order to hand over from sales/tendering department to project execution team
  • one of the main responsibilities is to ensure that the tendering management staff are fully aware of their contractual obligations and the commercial impacts of their actions
  • responsible for the financial-, ethical- and insurance checks together with the responsible departments
  • as a member of the core tendering team, you will be involved in all contractual briefings, issues, risks, processes and procedures related to the engagement contract. As you will work closely with the tender team, your operational reporting will be the Tender Manager
  • prepare contract summary including support and guidance to the tendering team on general contractual issues. Clarification of contractual/legal queries, if required by referring to the legal department
  • identification of customer/consortium and other third party obligations including development of the Project Contract Management Plan
  • assist the Tender Manager by reviewing, commenting and advising on received contract documentation in liaison with the internal legal department, insurance department and financial department
  • facilitate, analyse and comment on received information from responsible departments concerning contractual, financial and/or Insurance matters
  • preservation of ENGIE Fabricom’s rights and entitlements
  • you monitor, manage and/or mitigate contractual risks and opportunities. You advice on the contractual implications of proposed changes
  • support the management of project risks & opportunity identification and analysis by development and/or monitoring of appropriate ‘Golden Rules’ in liaison with the internal legal department
  • review and manage contractual incoming correspondence and prepare/review outgoing correspondence
  • you establish and maintain the engagement’s contractual compliance processes and procedures, identifying non-compliance issues and supporting their resolution. You assure that all legal documents are correctly maintained and updated
  • establishment and implementation of tender specific contractual procedures, particularly regarding insurances, warranties, bonds, variation orders, correspondence and notifications
  • providing contract management support, as required, in the event of a (potential) dispute. Provide the Head of Contracts & Risks a monthly tendering contractual activity report
  • undertaking any other contractual/commercial tasks as instructed/requested by Commercial Director and/or Head of Contracts & Risks
  • assistance in contractual briefings and meetings with stakeholders

Your profile

  • degree in engineering, quantity surveying, business administration or law
  • experience in (tendering) large complex capital projects and preferable some exposure to site construction issues
  • experience of high level negotiations
  • understanding of contract law, knowledge of FIDIC (red book & yellow book) contracts is essential
  • technical/legal/financial understanding
  • preferably knowledge of German law and/or French law and/or English law
  • understanding of tendering and project risk management
  • strong communication skills
  • hands-on mentality and business minded
  • analytical skills and written communication is one of your strong points
  • be able to dive into the details of non-contractual matters such as engineering, cost control, planning and construction in order to provide relevant contractual support
  • team player, yet you are able to work independently and duly manage your workload and priorities
  • you communicate easily and efficiently with your colleagues, clients and third parties
  • fluent in Dutch and English, with a thorough knowledge of the legal vocabulary
